The present system separates legislative, executive, and judicial power. Article V requires supermajority proposal and ratification for constitutional amendments, and protects each state's equal Senate suffrage without its consent.

The 2026 federal individual income-tax schedule already rises through seven marginal rates from 10% to 37%. The policy dispute is over the tax base, rates, exemptions, and use of revenue—not whether any progressive taxation exists.

The present system regulates private enterprise but leaves most production and employment decentralized. Small firms alone provide 45.9% of private-sector jobs and 43.5% of GDP.

The Constitution protects speech, press, assembly, petition, and religious exercise against government abridgment. Restrictions remain subject to judicial review.

The national DSA program does not identify a replacement custodial institution for people convicted of murder, rape, organized violent crime, or other offenses requiring incapacitation.

The existing constitutional model retains police, courts, detention, and prisons while the Fourth through Eighth Amendments impose warrants, due process, trial, counsel, bail, and punishment constraints.

ICE enforces federal immigration and customs laws, conducts interior enforcement, and investigates transnational crimes. Changing or abolishing it requires federal legislation and does not itself erase the underlying immigration statutes.

The 2026 U.S. intelligence assessment identifies China, Russia, Iran, and North Korea as strategic competitors or adversaries and describes continuing nuclear, missile, military, and cyber threats.

The Constitution assigns Congress the powers to fund armed forces and declare war while making the President commander in chief, dividing civilian authority rather than vesting it in one institution.
